On November 10, 2016, Wendy Margolis argued the case of Barrett v. Union Pacific Railroad Company in the Oregon Supreme Court.   This mandamus proceeding involved the application in Oregon of the United States Supreme Court’s decision in Daimler AG v. Bauman regarding the constitutional limitations on a state court’s authority to exercise general personal jurisdiction over an out-of-state defendant in an action arising from its out-of-state activities.  The defendant railroad is a Delaware corporation that does business in Oregon but is headquartered in Nebraska.  The plaintiff, an Oregonian who worked for the railroad, filed suit in an Oregon state court seeking damages for an accident that occurred in Idaho.  The Oregon Supreme Court should issue a decision within the next four to six months.
