Two of Cosgrave’s partners were featured in the March 2017 issue of The Main Line, a National Association of Railroad Trial Counsel (NARTC) publication.  Partner Tim Coleman was featured for being a frequent speaker at NARTC meetings and for his active participation on many committees.  He recently presented “Money:  Railroad Economics and Some Damages Too” at the winter meeting in Phoenix, Arizona.  Tim also completed a large project for the NARTC membership that involved organizing materials that can be used as a quick reference regarding railroad economics and damages.

 

Partner Wendy Margolis was recognized for her victory in Barrett v. Union Pacific Railroad Co..  The Oregon Supreme Court held that the Due Process Clause of the Fourteenth Amendment to the U.S Constitution, as construed in Daimler AG v. Bauman, prohibits Oregon courts from exercising general personal jurisdiction over Union Pacific for claims unrelated to Union Pacific’s business activities in Oregon.  This is an important decision for out-of-state corporations that, like Union Pacific, have substantial business operations in Oregon but are incorporated and have their principal places of business elsewhere.
